Raskolnikov’s theory — that extraordinary people are exempt from ordinary morality — collapses not through external punishment but through the internal machinery of his own mind. The investigation isn’t legal, it’s psychological. Porfiry Petrovich doesn’t need evidence; he needs Raskolnikov to convict himself.
